On December 9, 1959, the plaintiff, Mrs. Verna Peterson, placed a phone call to the Sinclair Refining Company terminal in Green Bay and ordered some fuel oil, in the name of her husband, the plaintiff John Peterson. Later the same day the fuel oil and some gasoline, an order for which was previously placed by John Peterson, were simultaneously delivered to the Peterson residence by the defendant, Norbert Bougie. He was a 'commissioned driver' of the defendant, Sinclair. As pertinent, details of this relationship are set forth in the opinion.
