This action was commenced by service of the summons and complaint on the defendant on December 7, 1939. The plaintiff alleges that he is the owner of certain real estate described in the complaint and that the defendant during all of the time between September 1 and October 14, 1939, was the owner of thirty head of cattle; that at various times between these dates defendants cattle trespassed upon the plaintiffs land and destroyed a crop of millet and hay to the plaintiffs damage in the sum of $50.
